The Commission shall not revoke any license under this chapter in the absence of some fault of the licensee or upon a finding of facts merely showing non-compliance with licensure or registration requirements unless failure to comply with such requirements has caused a deliberate, flagrant or repeated violation. Any corporation or association holding a license granted by the Commission under this chapter may, with the approval of the Commission, extend the scope and effect of such license without prior notice to, or the consent of, any other corporation or association. Any public service company specifically authorized and granted by the Commission under this chapter to construct any toll crossing (other than a railroad or any other bridge) shall not be required to construct any railroad underpass or overpass required by the said Act. For the purposes of the provisions of this section, every corporation or person who is conducting or transacting business in this Commonwealth as a corporation or person, whether such business be public or private, shall be deemed to be engaged in the construction, operation or maintenance of a railroad underpass or overpass under a license granted by the Commission under this chapter.
The Commission may revoke or suspend for cause any order of approval or issuance of a license in whole or in part, whenever it shall appear that the public interest requires that it should be taken away from such operator and revoked or suspended for such cause.
No license shall be issued by the Commission or renewed by any public service company pursuant to this day except upon the filing of a proper application in triplicate with the Commission by such applicant, in the manner directed herein, and upon compliance by such applicant with the provisions hereof or with such regulations as the Commission may from time to time prescribe, but such regulations shall not be inconsistent with the provisions of this chapter or the provisions of any other law under the control of the Commission. d2c66b5586
